En el trabajo "El mérito ejecutivo de fa póliifi de seguro y sus implicaciones frente al proceso rjecutivo", se busca responder la siguiente preglli11ta problemática: ¿Cuáles son las condiciones y límites para que la póliza de seguro se constituya en fundamento para la satisfacción de un derecho cierto por vía del proceso ejecutivo? En el desarrollo del ensayo se considera que la póliza de seguro, en los términos dispuestos por el artículo 1053 del Código de Comercio, se constituye en un (...) evento especial por el que se posibilita la ejecución, aunque no se cumplan los requisitos consagrados en el artículo 488 del Código de Procedimiento Civil. En el trabajo se presenta un cuestionamiento crítico frente a la regulación existente sobre el carácter ejecutivo de la póliza de seguro. Se estudian las connotaciones especiales del artículo 1053 del Código de Comercio frente a la regla general de los títulos ejecutivos del artículo 488 del Código de Procedimiento Civil. Adicionalmente, se establecen parámetros para entender cuándo la aseguradora ha objetado de manera seria la reclam.ación, y acerca de los cómputos frente al plazo que se tiene para objetar. Se consideran las ventajas y deficiencias del proceso ejecutivo para.obtener la satisfacción del derecho del asegurado o beneficiario en los eventos del artículo 1053 del Código de Comercio. De otro lado, se analizan las implicaciones surgidas del silencio de los aseguradores que dentro del plazo legal no objetan las reclamaciones realizadas. Finalmente, se delimitan los problemas que surgen en el proceso de ejecución, desde un perfil teórico procesal, teniendo en cuenta el postulado constitucional del debido proceso. (shrink)

El recurso de amparo en España es la principal garantía jurisdiccional para la protección dederechos definidos como fundamentales por la Constitución frente a actos concretos de las autoridades públicas y secundariamente de particulares. En este estudio se reflexiona sobre el referido mecanismo de tutela reforzada y privilegiada existente en el país europeo. El amparo constitucional es una garantía que sólo es posible considerar frente a aquellos derechos que en España se comprenden como fundamentales, no incluyendo numerosos derechos constitucionales o derechos (...) humanos que no se ajustan a la referida categoría conceptual.El Tribunal Constitucional se constituye en la sede básica para la resolución del amparo considerado como un recurso extraordinario, excepcional y subsidiario de protección de derechos fundamentales. Aunque sus sentencias de amparo resuelven casos concretos, sus motivaciones o consideraciones contienen parámetros para la interpretación de los referidos derechos, vinculando los poderes públicos frente a un razonamiento que pasa a tener un valor erga omnes.En este ensayo se busca contribuir, en cuanto a derecho comparado, en el estudio de las vecindades y diferencias del amparo con la acción de tutela en el caso colombiano. El presente artículo pretende hacer una presentación de la filosofía de Peirce definida por él como idealismo objetivo, la puerta de entrada a esta definición de su filosofía está inscrita en la comprensión y funcionamiento de las tres categorías configuradoras de la realidad se hará un exposición de las tres categorías, haciendo un énfasis especial en la de terceridad, punto de quiebre de la definición del idealismo objetivo como un realismo escolástico.

A version of intuitionistic type theory is extended with opposite types, allowing a different formalization of negation and obtaining a paraconsistent type theory (⁠|$\textsf{PTT} $|⁠). The rules for opposite types in |$\textsf{PTT} $| are based on the rules of the so-called constructible falsity. A propositions-as-types correspondence between the many-sorted paraconsistent logic |$\textsf{PL}_\textsf{S} $| (a many-sorted extension of López-Escobar’s refutability calculus presented in natural deduction format) and |$\textsf{PTT} $| is proven. El propósito es explicar cómo la crisis de la institución familiar lleva implícita una crisis en el sujeto humano, que desde la auto­nomía y la libertad se proponía como proyecto de vida conformar una familia. El modelo de análisis está centrado en esa configu­ración de las nuevas formas de familia, mediadas por el influjo de las tecnologías, especialmente, las fotografías digitales o las selfies como formas de expresión cotidiana donde ya no está presente la narración ni la historia, aunque sí (...) está la imagen. La metodología de investigación utilizada en este análisis es la hermenéutica feno­menológica a partir de manifestaciones relacionales mediadas por un generador de significado como es la selfie que se pone presente en este espacio conjunto de realidad y virtualidad. La tarea desde la educación es ser propositivos construyendo con los jóvenes nuevos sentidos de esperanza para que esas nuevas formas de familia sean espacios de amor. (shrink)

Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. Es celebre la definición que hiciera James de la experiencia mística a partir de cuatro rasgos: la inefabilidad, la cualidad noética, la pasividad y la transitoriedad. Por su parte la fenomenología de la mística contemporánea ha señalado la necesidad de distinguir las experiencias místicas de otros tipos de experiencia de trascendencia, y para ello autores como Juan Martín Velasco han rescatado la relevancia de un rasgo que para James era secundario, a saber, la pasividad. A partir de este aporte, (...) es posible entablar un diálogo entre ciencia y mística y lograr así una definición naturalizada de la experiencia mística que revele la importancia tanto de la pasividad mística como de las técnicas para lograrla, de modo que se considere la experiencia mística en su calidad de vía mística. En este ensayo planteo la posibilidad de una renovación de la antropología filosófica desde la perspectiva ontológica del nuevo realismo, particularmente desde las teorías filosóficas de Markus Gabriel y Quentin Meillassoux. Previamente expongo la discusión sobre la antropología filosófica que se produjo en el siglo pasado, especialmente las disputas entre Ernst Cassirer y Martin Heidegger y entre Heidegger y Jean-Paul Sartre. Doy cuenta también de las líneas principales de la corriente filosófica del “nuevo realismo”. La idea de utopía tiene una larga historia en América y un vasto conjunto de significados. En este trabajo se interpreta a las utopías a partir de un enfoque utopológico basado en las reflexiones principalmente de M. R. Ramírez Fierro, A. A. Roig, H. Cerutti Guldberg y E. Fernández Nadal. Desde ese marco teórico se analiza una utopía concreta contemporánea de la Patagonia argentina. Se trata del barrio intercultural proyectado en San Martín de los Andes por la comunidad (...) mapuche “Curruhuinca” y la Asociación Vecinos Sin Techo de esa ciudad. Aquí, describo el carácter utópico de dicho proyecto tomando como categorías de análisis los conceptos de función y tensión utópicas en relación a los distintos aspectos que ponen en juego la interculturalidad y la emergencia de nuevas subjetividades. The idea of utopia has a long history in America and a vast array of meanings. This paper interprets utopias from a utopological approach primarily based on the reflections of M. R. Ramirez Fierro, A. A. Roig, H. Cerutti Guldberg and E. Fernández Nadal. From this theoretical framework a contemporary concrete utopia of Argentine Patagonia is analyzed. It is an intercultural neighborhood in San Martin de los Andes projected by the Mapuche community “Curruhuinca” and the Homeless Neighbors Association of that city. Here, I describe the utopian character of the project taking the concepts of function and utopian tension as categories of analysis in relation to the different aspects that involve interculturality and the emergence of new subjectivities. Lifestyle refers to a set of personal and group behaviours related to normative and semantic aspects of social life. Any coherent set of behavioural patterns derived from religious teachings that exist in life can be considered a religious lifestyle. Considering that the dominant religion in Jordan is Islam, the present study focused on the Islamic lifestyle. In addition, given that the correct relationship between couples has been compared to life-giving blood in marriage, and since the quality of marital role plays (...) a determining role, the existence of communication skills in any of the couples can generate satisfaction and compatibility, whereas lack of awareness of these skills could cause misunderstandings and tension. Therefore, the current study aims to study the role of the Islamic lifestyle in communication skills of 250 Muslim couples of Jordan (Amman, Zarqa and Irbid) in 2022. Data were collected using questionnaires during four months, and the validity and reliability was confirmed. In addition, data analysis was performed in Statistical Package for Social Sciences (SPSS) and Linear Structural Relations (LISREL) using mean tests and structural equation modelling. According to the results, Islamic lifestyle had a positive, significant effect on the improvement of communication skills in Muslim couples in Jordan (P-value: 0.76; T-value: 7.92). Therefore, it is recommended that more attention should be paid to this issue by families, researchers and cultural authorities in the country.Contribution: Our findings revealed that Islamic lifestyle improved communication skills in Muslim couples, which demands special attention. By adhering to the Islamic lifestyle, couples can influence each other’s knowledge, emotions, education and growth, and try to have a realistic understanding of each other’s desires, needs, living environment and perceptions that each has in life issues. Furthermore, they can organise their role in the common life in appropriate ways to prevent problems and solve them in the event of problems. (shrink)

Earlier in this century, many philosophers of science (for example, Rudolf Carnap) drew a fairly sharp distinction between theory and observation, between theoretical terms like 'mass' and 'electron', and observation terms like 'measures three meters in length' and 'is _2° Celsius'. By simply looking at our instruments we can ascertain what numbers our measurements yield. Creatures like mass are different: we determine mass by calculation; we never directly observe a mass. Nor an electron: this term is introduced in order to (...) explain what we observe. This (once standard) distinction between theory and observation was eventually found to be wanting. First, if the distinction holds, it is difficult to see what can characterize the relationship between theory :md observation. How can theoretical terms explain that which is itself in no way theorized? The second point leads out of the first: are not the instruments that provide us with observational material themselves creatures of theory? Is it really possible to have an observation language that is entirely barren of theory? The theory-Iadenness of observation languages is now an accept ed feature of the logic of science. Many regard such dependence of observation on theory as a virtue. If our instruments of observation do not derive their meaning from theories, whence comes that meaning? Surely - in science - we have nothing else but theories to tell us what to try to observe. (shrink)

Social attitudes toward usury (here defined using the archaic meaning as the taking of interest on loans) have changed dramatically over the centuries. From antiquity until the Protestant Reformation, usury was regarded as an inherently evil activity. Today, with few exceptions, usury is met with moral indifference. Modern objections to usury are limited to protest against "excessive" interest rates rather than interest per se. With this change in focus, the very meaning of the term "usury" has also changed. Many early (...) pronouncements against the taking of interest emphasized the plight of the poor, but ironically, the poor actually pay the highest rates of interest in the modern American economy. Despite the universality of usury, some socio-economic subcultures still manage to avoid the taking or giving of interest. Orthodox branches of both Judaism and Islam have maintained bans on usury throughout the centuries and up to the present time. This is especially interesting in the case of Judaism, given the popular cultural image of the Jew as usurer. Jewish free loan systems may actually offer a model for modern loan programs that can be designed to aid poor borrowers, who are frequently shut out of mainstream financial services. (shrink)

Nella sua riflessione, infatti, l’autore esprime l’idea di un Dio che non si sovrappone af­­fatto agli (...) uomini, ma si colloca accanto a loro, manifestandosi nelle isti­tu­zio­ni mondane, quando siano fon­date sulla giustizia e sull’uguaglianza.By drawing into question Ferdinand Tönnies ancient remarks on the ine­vi­ta­bility of the transition from community to society – according to the former, a ty­pical feature of modernity – Martin Buber claims the need, both political and re­ligious, to build a post-social community, in which the socialist and liber­tarian aspiration for a ‘good life’ and the spiritual need to realize God in hu­man relations with our fellow men may materialize. Daniel Taylor and Dawn Goodwin present a case study of the Morecambe Bay Inquiry (MBI), which examined the high rate of maternal and neonatal deaths over a period of 9 years (2004–2013), within the small maternity unit of Furness General Hospital (FGH), one of the three hospitals comprising Morecambe Bay Hospitals Trust.1 They examine this through a conceptual lens, and provide a solution involving changes in medical education. This commentary explores both these elements. First, they use the lens of ‘Normalisation (...) of Deviance’ (NoD) to explain organisational failure. However, other available lenses such as ‘Sociology of Disasters’, ‘Organisational Silence’ and ‘Comfort-seeking Behaviour’ may point to different problems and solutions. More justification for their choice of the lens of NoD would have been useful. Similarly, more justification for their focus on a cluster of five ‘serious untoward incidents’ (SUIs) occurring in 2008 would also have been useful. They suggest that before 2008, the perinatal mortality rate was low, patient satisfaction was high and recent level 2 accreditation of maternity services by the Clinical Negligence Scheme for Trusts all suggested standards of care within the obstetric department were adequate. This stream of positive signals is likely to have contributed towards a genuine belief of safe operation within the maternity unit by staff and board members. I discuss two puzzling and neglected passages in the Critique of Practical Reason, namely, V:92 and V:163. In these passages Kant claims that practical philosophers should follow the paradigm of the chemist and conduct experiments on common human reason. I explain Kant’s conception of the chemical experiment, provide a detailed interpretation of the two passages in question, and conclude by applying the structure of the chemical experiment to the Analytic of the Critique of Practical Reason. Chemical experiments as a model (...) of ethics should be understood as a method of confirming that a philosophical theory systematizes and defends ideas that ordinary rational agents are already committed to.
